Terms of Service

Effective date: October 15, 2026

1. Agreement to these Terms

These Terms of Service (the "Terms") are a binding agreement between you and NMN Investments, LLC, a Florida limited liability company doing business as MyCoffeeSettings ("MyCoffeeSettings," "MCS," "we," "us," or "our"). They govern your use of the MyCoffeeSettings website at mycoffeesettings.com, our mobile applications, and all related features and services (together, the "Service").

By creating an account, or by accessing or using the Service, you agree to these Terms and to our Community Guidelines, which are part of these Terms, and you acknowledge our Privacy Policy. If you do not agree, do not use the Service.

IMPORTANT: SECTION 17 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER. UNLESS YOU OPT OUT WITHIN 30 DAYS AS DESCRIBED IN SECTION 17, DISPUTES BETWEEN YOU AND MCS WILL BE RESOLVED BY INDIVIDUAL ARBITRATION, AND YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that a user is under 13, we will delete the account and its personal information.

You may not use the Service if we have previously suspended or removed your account, or if you are barred from using it under applicable law.

3. Your account

You need an account to save settings, keep a journal, post in the community, and register for events. Browsing coffees, roasters, and public content does not require an account.

When you create an account, you agree to:

  • provide accurate information and keep it current;
  • keep your password confidential and not share your account with anyone;
  • choose a username that does not impersonate another person, roaster, or business, and does not infringe anyone's rights; and
  • notify us at info@mycoffeesettings.com promptly if you believe your account has been accessed without your permission.

You are responsible for all activity on your account. We do not delete accounts for inactivity; your account and journal remain available until you delete them or we terminate the account under section 12.

4. The Service and grind settings

MCS is a community platform for specialty coffee. It lets you record and organize grind settings and brewing notes in a personal journal, browse coffees and roasters, discover events, and take part in community discussions.

Settings are starting points, not guarantees. Grind settings and brewing information on the Service, whether entered by you, other users, roasters, or shown as community averages, are general information. Results depend on many factors outside our control, including your grinder model and calibration, burr wear, the age and storage of the coffee, water, equipment, and technique. We do not guarantee that any setting will produce a particular result, and you use any setting at your own discretion.

Roaster Recommended settings. A "Roaster Recommended" label means the setting was provided by an Official Roaster, whose identity and business we have verified, for a coffee that roaster produces. It is the roaster's suggested starting point. It is not a warranty or guarantee by MCS or by the roaster, and MCS does not test or independently verify roaster settings.

Community averages. Community settings are calculated from anonymized, aggregated data contributed by users. They may be incomplete, outdated, or based on a small number of entries.

AI label scanning. The bag-label scan uses a third-party AI service to suggest coffee details from a photo you provide. AI results may be inaccurate or incomplete. You are solely responsible for reviewing and correcting every detail before saving it, and for the accuracy of anything you save or publish. If you do not want to rely on the scan, you may instead enter the details manually and use your own photo. MCS makes no warranty about the accuracy of AI-generated results.

We may add, change, suspend, or discontinue any part of the Service at any time. Where a change materially reduces your ability to access your own journal data, we will give you reasonable notice and an opportunity to export it where practicable.

5. Your content

"Your Content" means anything you submit to the Service, including grind settings, journal entries, tasting notes, ratings, photos, profile information, posts, comments, and event listings.

You own Your Content. These Terms do not transfer ownership of Your Content to us.

Private and public content. Your settings and journal entries are private by default. Content you choose to make public, and content you post in public areas of the Service (such as your profile, public presets, posts, and comments), is visible to other users and to visitors who are not logged in.

License to MCS. You grant MCS a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt (for example, to resize or format), publish, display, and distribute Your Content:

  1. to operate, provide, improve, and promote the Service;
  2. for Your Content that is public, to feature it in MCS's own marketing and social media channels, with credit to your username where practicable; and
  3. for all settings data you contribute, public or private, to create anonymized, aggregated statistics such as community averages, which do not identify you.

The license for public Content ends when you delete that Content or your account, except that (a) anonymized aggregated statistics may continue to be used, (b) copies may remain in backups for a limited period, and (c) marketing materials already published need not be withdrawn. Private content is never used in marketing.

Your promises. You represent that you own or have the rights to submit Your Content, that it is accurate to the best of your knowledge, and that it does not violate these Terms, the Community Guidelines, or anyone's rights. Do not upload photos of people without their permission.

Feedback. If you send us suggestions or ideas, we may use them without any obligation to you.

6. Privacy and location

Our Privacy Policy explains what information we collect, how we use it, and the choices you have. Key points:

  • Location. If you allow it, the Service uses your device's precise location only while you are using it, to show nearby events and features. We use it at that moment and do not store it on our servers. You can turn location off at any time in your device settings, and the Service works without it.
  • Event registrations. When you register for an event created by a roaster or other organizer, your name and email address are shared with that organizer so they can run the event. You will see this notice before you register.
  • Analytics. We do not use third-party analytics, tracking, or advertising tools. We do not sell your personal information or use it for third-party advertising.

In the event of any conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls.

7. Acceptable use

You agree not to, and not to help anyone else to:

  • post content that is unlawful, harassing, hateful, threatening, sexually explicit, or that violates the Community Guidelines;
  • post false or misleading settings, reviews, or event listings, or manipulate votes, ratings, or rankings, including through multiple accounts;
  • impersonate any person, roaster, or business, or falsely claim roaster status or an affiliation;
  • post spam or unsolicited advertising, or use information obtained through the Service (including other users' contact details) to send unsolicited messages;
  • infringe anyone's intellectual property, privacy, or publicity rights;
  • scrape, crawl, or harvest data from the Service, or copy the settings database, by automated means without our written permission;
  • use the Service or its content to train machine learning or AI models without our written permission;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe or test their vulnerabilities;
  • reverse engineer the Service except where the law expressly permits it; or
  • use the Service in violation of any applicable law.

8. Roasters

Roaster accounts have two levels. Every roaster account starts as an Unofficial Roaster, which may upload its own coffees and settings (shown as unverified) but cannot claim existing coffee pages or create events. After MCS verifies the person's identity and the business, MCS may grant Official Roaster status at its discretion, case by case, to businesses that roast their own coffee. Official Roasters receive the Official checkmark and may claim coffee pages, publish Roaster Recommended settings, and create events.

If you apply for or hold roaster status, you also agree to the MCS Roaster Terms, which form part of these Terms. You represent that you are authorized to act for the roastery you represent, and that the information you provide about the business and its coffees is accurate. We may remove roaster status at any time, including if the business no longer meets our criteria.

9. Events

MCS lets roasters and other organizers list events and lets users register for them. For events listed by others, MCS is only a listing platform. The organizer named on the event listing is solely responsible for the event, including its content, venue, safety, accuracy of the listing, any fees, cancellations, and compliance with law.

MCS does not attend, supervise, or control events organized by others and makes no promises about them. Any dispute about such an event is between you and the organizer. You attend events at your own risk.

When you register, your name and email address are shared with the organizer, who may use them only to manage the event and as permitted by the Roaster Terms and applicable law. Organizers may record attendance and check-in status.

Events that MCS itself organizes are identified as MCS Events on their listing and are governed by the MCS Event Terms, which you accept at registration.

10. Third-party links and services

The Service links to websites, online stores, and social media pages operated by roasters and other third parties. MCS does not sell coffee or other products, is not a party to any purchase you make from a third party, and is not responsible for third-party websites, products, or services. Your dealings with third parties are governed by their own terms and privacy policies.

11. Our intellectual property and copyright complaints

The Service, including its software, design, logos, the MyCoffeeSettings name, and the compilation of the settings database, is owned by MCS or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes (or, for roasters, for the business purposes the Roaster Terms permit). All rights not expressly granted are reserved.

Third-party trademarks. Roaster names, coffee names, logos, label artwork, and other brands that appear on the Service belong to their respective owners. MCS uses roaster and coffee names solely for informational purposes, to identify the roasters, brands, and coffees they refer to. MCS does not sell coffee or any other roaster products. Unless a roaster is marked with the Official checkmark, its page and coffee listings were added by the community or by an account whose connection to that roaster MCS has not verified, and neither that roaster nor any other brand shown on the Service is affiliated with, sponsors, or endorses MCS, nor does MCS claim ownership of any of their marks or content. Owners who want content changed or removed can contact info@mycoffeesettings.com or apply for Official Roaster status to manage their own pages.

Copyright complaints. We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send a notice to our designated agent: Ignacio Nedeff, NMN Investments, LLC, 920 Coral Way, Coral Gables, FL 33134, info@mycoffeesettings.com. Your notice must include the information required by 17 U.S.C. ยง 512(c)(3). Details, including how to submit a counter-notice, are in our Copyright Policy. We terminate the accounts of repeat infringers in appropriate circumstances.

12. Moderation, suspension, and termination

We may review, remove, hide, or restrict any content, and suspend, restrict, or terminate any account or roaster status, at our discretion and at any time, including if we believe a user has violated these Terms or the Community Guidelines, created risk or legal exposure for MCS or others, or harmed the community. Where practical, we will notify you of the action and the reason. We are not obligated to monitor content, and our decision not to act in one case does not waive our right to act in another.

You can report content or users through the reporting tools in the Service, and you can block other users. If you believe we removed your content or restricted your account in error, you may appeal by contacting info@mycoffeesettings.com.

Sections 5 (as to aggregated data and feedback), 11, and 14 through 20 survive termination of these Terms.

13. Deleting your account

You can delete your account at any time from within the app or on the website under Settings, or by emailing info@mycoffeesettings.com. When you delete your account:

  • your account, profile, private settings, journal entries, and photos are deleted, along with the other personal information described in the Privacy Policy;
  • your public posts and comments remain visible but are anonymized and shown as written by "deleted user";
  • anonymized, aggregated statistics derived from your settings remain part of community averages; and
  • residual copies may remain in backups for a limited period before being overwritten, and we may retain information we are legally required to keep or need to resolve disputes or enforce these Terms, as described in the Privacy Policy.

Deletion cannot be undone. Before deleting, you can request a copy of your data by contacting info@mycoffeesettings.com.

14. Disclaimers

THE SERVICE AND ALL CONTENT, INCLUDING GRIND SETTINGS, ROASTER RECOMMENDED SETTINGS, COMMUNITY AVERAGES, AND EVENT LISTINGS, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, MCS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

MCS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY CONTENT IS ACCURATE OR RELIABLE, OR THAT ANY SETTING WILL PRODUCE A PARTICULAR RESULT. MCS IS NOT RESPONSIBLE FOR CONTENT POSTED BY USERS OR ROASTERS, FOR EVENTS ORGANIZED BY OTHERS, OR FOR THIRD-PARTY PRODUCTS OR WEBSITES. MCS IS NOT RESPONSIBLE FOR ANY COFFEE, EQUIPMENT, OR GRINDER DAMAGE ARISING FROM YOUR USE OF ANY SETTING.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MCS OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PRODUCT (INCLUDING COFFEE), ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF MCS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, MCS'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO MCS FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

These limitations are an essential part of the bargain between you and MCS and allow us to offer the Service free of charge. They do not limit liability that cannot be limited under applicable law, such as liability for gross negligence, willful misconduct, or fraud. If any part of this section is held unenforceable, the remaining parts will be enforced to the fullest extent permitted, and the unenforceable part will be replaced with the enforceable limitation that most closely reflects the parties' intent.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MCS and its members, managers, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms or of any law, or (d) your violation of anyone's rights, including in connection with any event you organize. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with our defense.

17. Dispute resolution and arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

(a) Informal resolution first. Before starting arbitration or a small claims case, you and MCS agree to try to resolve any dispute informally. The party raising the dispute must send a written notice describing the claim and the relief sought (to MCS at info@mycoffeesettings.com and 920 Coral Way, Coral Gables, FL 33134; to you at your account email). If the dispute is not resolved within 60 days after the notice is received, either party may proceed. Statutes of limitation are paused during this period.

(b) Agreement to arbitrate. Except as provided in subsection (c), any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including their formation, interpretation, enforceability, or scope, will be resolved by final and binding individual arbitration. The arbitrator, not a court, decides all such questions, except that a court decides disputes about subsections (e) and (g). This agreement is governed by the Federal Arbitration Act.

(c) Exceptions. Either party may (1) bring an individual claim in small claims court if it qualifies, and (2) seek injunctive or other equitable relief in court for the infringement or misuse of intellectual property rights.

(d) Rules and procedure. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, before a single arbitrator. Hearings will take place by video or telephone, or in person in the county where you live if you request it, or in Miami-Dade County, Florida, if both parties agree. Fees are allocated as the AAA Consumer Rules provide. The arbitrator may award any individual relief available in court, and the award may be entered in any court with jurisdiction.

(e) Class action waiver. YOU AND MCS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND MCS WAIVE ANY RIGHT TO A JURY TRIAL. If this waiver is found unenforceable as to any claim, that claim must be severed and decided in court, and the remaining claims will proceed in arbitration.

(f) Mass arbitration. If 25 or more similar demands for arbitration are filed against MCS by or with the help of the same or coordinated counsel, the demands will be administered in batches of up to 10, with one arbitrator per batch, and the remaining demands held until each batch is resolved. Filing fees for held demands are not due until that demand is placed in a batch. The parties will cooperate in good faith to resolve the demands efficiently, including through mediation.

(g) 30-day right to opt out. You may opt out of this arbitration agreement by emailing info@mycoffeesettings.com within 30 days after you first accept these Terms, with the subject line "Arbitration Opt-Out" and your name and account email. Opting out does not affect any other part of these Terms. In particular, the disclaimers (section 14), the limitation of liability (section 15), indemnification (section 16), and the governing law, venue, jury trial waiver, and class action waiver (section 18) continue to apply in full to any claim you bring in court.

(h) Changes. If MCS changes this section, you may reject the change by emailing info@mycoffeesettings.com within 30 days of the change; in that case the version you last accepted continues to apply to you.

18. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules, and by applicable federal law. For any claim not subject to arbitration, you and MCS consent to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, except that small claims may be brought in the county where you live. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND MCS KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE THAT IS DECIDED IN COURT. TO THE FULLEST EXTENT PERMITTED BY LAW, ANY SUCH CLAIM MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. This waiver applies whether or not you have opted out of arbitration under section 17(g).

19. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email and by a notice in the Service at least 14 days before the changes take effect. Changes that are not material, such as clarifications, corrections, or changes required by law, may take effect when posted. The "Effective date" at the top shows when the Terms were last updated.

If you continue to use the Service after changes take effect, you accept the updated Terms. If you do not agree, you must stop using the Service and may delete your account. Changes do not apply to disputes already pending or to claims of which either party had notice before the change took effect.

20. General terms

  • Entire agreement. These Terms, together with the Privacy Policy, Community Guidelines, Copyright Policy, Cookie Policy, (for roasters) the Roaster Terms, and (for MCS Events) the Event Terms, are the entire agreement between you and MCS about the Service.
  • Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible or modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms without our written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • No third-party beneficiaries, except as stated in section 21.
  • Electronic communications. You consent to receive notices and agreements electronically, which satisfy any requirement that they be in writing.
  • Headings are for convenience only and do not affect interpretation.

21. App store terms

If you download our app from the Apple App Store or Google Play, you must also comply with that store's terms. The following applies to apps obtained from the Apple App Store (the "iOS App"):

  1. These Terms are between you and MCS only, not Apple. MCS, not Apple, is solely responsible for the iOS App and its content.
  2. Your license to use the iOS App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
  3. Apple has no obligation to provide any maintenance or support for the iOS App.
  4. If the iOS App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the iOS App.
  5. MCS, not Apple, is responsible for addressing any claims by you or a third party relating to the iOS App, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
  6. MCS, not Apple, is responsible for the investigation, defense, settlement, and discharge of any claim that the iOS App or your use of it infringes a third party's intellectual property rights.
  7. You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
  8. Questions, complaints, or claims about the iOS App should be directed to MCS at the contact details in section 22.
  9. You must comply with applicable third-party terms when using the iOS App.
  10. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
